Menu Explain is a convenience tool, not a food-safety or medical service. The text output is generated by artificial intelligence and may be inaccurate, incomplete, or wrong — including translations, dish descriptions, ingredient lists, allergen flags, calorie figures, and price conversions. Dish images are illustrative examples of that type of dish, not photographs of the actual item the restaurant serves, and may look different from what you receive. The app shows possible allergens only (“may contain”) and never confirms that a dish is safe or free of any ingredient. If you have a food allergy, intolerance or medical dietary need, always confirm directly with the restaurant before you order or eat. You use the app at your own risk.

These Terms of Service (“Terms”) are a legal agreement between you and Mentioned In, LLC, a Delaware limited liability company that operates the Menu Explain app (“Menu Explain”, “we”, “us”), governing your use of the Menu Explain mobile application and related services (the “App”). By downloading, installing, or using the App, or by tapping “I agree,” you accept these Terms. If you do not agree, do not use the App.

1. Eligibility and acceptance

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the involvement and consent of a parent or guardian, and any purchase must be made or authorized by an adult. By using the App you confirm that you meet these requirements and that you have read and accepted these Terms and our Privacy Policy. If you use the App on behalf of an organization, you accept these Terms for that organization.

2. What the App does

The App uses your device camera and automated systems — including machine translation and artificial-intelligence models — to read restaurant menus and generate translated text, possible allergens, estimated calorie ranges, and approximate price conversions, and to show illustrative dish images. The text output is generated by software from an image you supply. The dish images are representative example photographs of that type of dish, not photographs of the actual item the restaurant serves. We do not see the actual dish, inspect its preparation, contact the restaurant, or verify what the kitchen does.

3. Food safety, allergens, health and accuracy — important

This is the most important section. By using the App you understand and agree that:

  • The text content is AI-generated. Translations, dish descriptions, ingredient lists, allergen flags, calorie and nutrition figures, and price conversions are produced by automated artificial-intelligence systems from a photo you supply, and may be inaccurate, incomplete, outdated, or wrong.
  • Images are illustrative only. Dish images are representative example photographs of that type of dish. They are not photographs of the actual item the restaurant will serve and may differ from it significantly in ingredients, preparation, and appearance. Do not rely on an image to judge a dish’s contents or safety.
  • Information only. All output is provided for general information and convenience. It is not professional, medical, nutritional, or dietary advice and is not a substitute for it.
  • Allergen indications are possibilities, not guarantees. When the App shows “may contain” a given allergen, it is flagging a possibility inferred by software. The App can miss allergens that are present, and its silence about an allergen does not mean the allergen is absent. The App never confirms that any dish is free of any allergen or ingredient.
  • You must verify with the restaurant. If you have any food allergy, intolerance, sensitivity, religious or medical dietary restriction, you must confirm the ingredients and preparation of every dish directly with restaurant staff before ordering or eating. Do not rely on the App for this.
  • Estimates are estimates. Calorie figures, nutritional information, portion sizes, and price conversions are approximate estimates and will often be inaccurate. Exchange rates change and are not guaranteed.
  • Translations may be wrong. Machine translation can misread menus, mistranslate dish names, and omit or invent ingredients.
  • Assumption of risk. You knowingly and voluntarily assume all risk arising from your use of, or reliance on, any information the App provides, including any allergic reaction, illness, injury, or other harm. This does not apply to liability that cannot be excluded by law (see Section 10).

4. Licence to use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use one copy of the App on a device you own or control, for your own non-commercial use, in accordance with the applicable app-store rules. You may not copy, modify, reverse-engineer, decompile, rent, resell, or create derivative works from the App, except to the extent this restriction is prohibited by law.

5. Your responsibilities

  • Use the App lawfully and only as intended.
  • Do not upload content you have no right to, and do not photograph people without their consent.
  • Do not interfere with, overload, or attempt to gain unauthorized access to the App or its systems.
  • Do not use the App to build a competing dataset or service, or to scrape our outputs at scale.

6. Scan Credits and day passes

The App offers optional one-time in-app purchases: Scan Credits, where each menu scan consumes one credit, and day passes, which give time-limited access. These are one-off consumable purchases — they do not auto-renew and you are never charged automatically; you are only charged when you choose to buy.

  • Billing. All purchases are processed by Apple or Google through their in-app purchase systems, under their terms, not by us directly. Prices are shown before purchase, and you are charged on confirmation.
  • What credits attach to, and how they can be lost. The App does not use logins. It identifies you by a user ID generated and stored on your device, and your Scan Credits and day passes are tied to that ID. Because the ID lives on the device, any credits or passes you hold may be permanently lost if you delete the App, reset your device, or switch to a new device, and they cannot be transferred or restored. Please use your credits on the device where you bought them.
  • No resale. Credits and passes are consumable and personal; they may not be sold, transferred, or exchanged for cash.
  • Refunds. Purchases are final except where a refund is required by applicable law. Refunds are handled by Apple or Google under their policies; contact the relevant store. Consumers in the EEA/UK retain any mandatory statutory withdrawal or refund rights.
  • Promotional credits. We may issue free or promotional credits, which may carry their own conditions and may expire. Credits you have paid for are not subject to inactivity expiration.
  • Pricing. We may change prices at any time; changes apply only to future purchases and do not affect credits you already hold.

7. Intellectual property

The App, its software, design, branding, and content (excluding menu images you supply and third-party content) are owned by Menu Explain or its licensors and are protected by intellectual property laws. These Terms grant you no rights in our trademarks or logos.

8. Third-party content and services

The App relies on third-party services, including app stores, machine-translation providers, and AI/vision providers, and it processes images of menus created by restaurants. We do not control and are not responsible for restaurant menus, the accuracy of third-party data, or third-party services, which are governed by their own terms. Restaurants, not Menu Explain, are responsible for the food they serve and the information they provide.

9. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the App will be accurate, reliable, uninterrupted, error-free, or that any output is correct, complete, or suitable for your needs.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Where implied warranties cannot be excluded, they are limited to the minimum period and extent permitted by law.

10. Limitation of liability

Mandatory-law carve-out (read first). Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any liability that cannot be excluded or limited under the law that applies to you. If you are a consumer resident in the European Economic Area (EEA) or the United Kingdom, you keep the benefit of all mandatory consumer-protection rights and remedies under the law of your country of residence, and nothing in these Terms reduces those rights.

Subject to the paragraph above, and to the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the App;
  • Our total aggregate liability for all claims relating to the App will not exceed the greater of (a) the total amount you paid us for the App in the twelve months before the claim, or (b) US $25.

These limits apply to all theories of liability (contract, tort, negligence, strict liability, or otherwise), even if we were advised of the possibility of the damages, and even if a limited remedy fails of its essential purpose.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Menu Explain and its owner from claims, losses, and reasonable legal costs arising from your misuse of the App or your breach of these Terms. This section does not apply to consumers to the extent prohibited by applicable consumer-protection law.

12. Changes to the App and these Terms

We may modify or discontinue the App, or update these Terms, at any time. If we make material changes, we will update the date above and, where required, notify you in the App. Continued use after changes take effect means you accept the updated Terms; if you do not accept them, stop using the App.

13. Termination

You may stop using the App and delete it at any time. We may suspend or end your access if you breach these Terms or misuse the App. Sections that by their nature should survive termination (including 3, 9, 10, 11, and 14) will survive.

14. Governing law and dispute resolution

14.1 If you are a resident of the United States

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. You and Menu Explain agree to resolve any dispute through final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and Menu Explain waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms; opting out does not affect the rest of these Terms.

14.2 If you are a consumer in the EEA, the United Kingdom, or elsewhere

The arbitration agreement and class-action waiver in Section 14.1 apply only to the extent permitted by the law of your country of residence, and do not apply to you if that law does not allow them. As an EEA or UK consumer, you benefit from the mandatory laws of your country of residence, you may bring proceedings in the courts of that country, and nothing in these Terms deprives you of those protections. EU consumers may also use the European Commission’s Online Dispute Resolution platform.

15. Apple App Store — additional terms

If you obtained the App from the Apple App Store, the following apply. These Terms are between you and Menu Explain only, not Apple, and Apple is not responsible for the App or its content. Your licence to use the App is limited to use on Apple-branded products you own or control, as permitted by the App Store Terms of Service. Menu Explain, not Apple, is solely responsible for the App, for any maintenance and support, for any product warranties (and for a refund of the purchase price if the App fails to conform to a warranty, to the extent Apple has no other obligation), and for addressing any claims relating to the App, including product-liability, legal, regulatory, and intellectual-property claims. You represent that you are not located in an embargoed country or on a prohibited-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Google Play — additional terms

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

17. General

If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor. These Terms are the entire agreement between you and us about the App.
